These Terms of Service ("Terms") govern your access to and use of the Best AI Solutions platform, including all associated services, AI agents, Ava, and related technologies (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Best AI Solutions provides an AI-powered Digital Workforce for local service businesses. The Service includes AI agents that autonomously perform marketing, communication, lead management, and operational tasks on behalf of your business under your direction. We are not a marketing agency, staffing firm, or technology reseller. We provide software-as-a-service.
You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your business. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.
The Service is offered on a monthly subscription basis. Fees are charged monthly in advance via the payment method on file. All fees are non-refundable except as expressly stated herein or required by law. You may cancel at any time by notifying Ava or through your Control Center. Cancellation takes effect at the end of your current billing period — you retain full access until that date. After cancellation, you retain read-only access to your data (reports, lead history, call transcripts) for 12 months, after which it is permanently deleted. Pass-through charges (domain registration, Google Workspace email) are billed as separate line items and are subject to their respective providers' terms.
AI agents act autonomously on your behalf based on your configurations and instructions. While we design agents for accuracy and professionalism, AI-generated content, responses, and actions are not guaranteed to be error-free. You are responsible for reviewing agent output and maintaining appropriate oversight. Best AI Solutions is not liable for business decisions made based on AI agent actions or recommendations. You should not rely solely on AI agents for legally sensitive communications, professional advice, or safety-critical decisions.
All interactions processed by AI agents — including phone calls, text messages, website chat conversations, and agent actions — are recorded, transcribed, and stored in an immutable audit trail. Recordings are stored with cryptographic verification to ensure integrity. By using the Service, you (a) consent to this recording and storage, and (b) agree to provide legally required disclosures to your customers (e.g., "This call may be recorded") before any recorded interaction. Compliance with applicable call recording laws in your jurisdiction is your responsibility. We provide disclosure language as part of the Service to assist with compliance.
You agree not to use the Service to: (a) send unsolicited commercial messages in violation of applicable law (CAN-SPAM, TCPA, CASL); (b) harass, threaten, or harm any person; (c) transmit malware, spam, or fraudulent content; (d) circumvent, disable, or interfere with security features; (e) use purchased, rented, or scraped contact lists for outreach through our platform; (f) impersonate any person or entity; or (g) use the Service in any manner that violates applicable law. We may suspend or terminate accounts that violate this policy without prior notice.
You retain ownership of all data, content, and materials you provide to or generate through the Service ("Your Content"). You grant us a limited, non-exclusive license to use Your Content solely to provide and improve the Service. We do not sell Your Content to third parties and do not use it to train AI models without your explicit consent. You represent that you have all rights necessary to provide Your Content and that it does not violate any third-party rights.
The Service integrates with third-party platforms including Google, Meta (Facebook/Instagram), Twilio, Stripe, Nextdoor, YouTube, Cloudflare, and others. Your use of those integrations is also subject to the respective third parties' terms of service. We are not responsible for the actions, content, availability, or policies of third-party services.
The Service, including all software, AI models, designs, trademarks, and content created by Best AI Solutions, is our exclusive property or licensed to us. Nothing in these Terms transfers any intellectual property rights to you. Content generated by AI agents on your behalf (posts, responses, ad copy, website content) is assigned to you upon creation.
To the maximum extent permitted by law, Best AI Solutions and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Service. Our total aggregate liability to you for any claim arising out of or related to these Terms or the Service shall not exceed the total fees paid by you in the three months preceding the claim.
You agree to indemnify and hold harmless Best AI Solutions and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of: (a) your use of the Service; (b) your violation of these Terms; (c) Your Content; (d) your violation of any applicable law or third-party rights; or (e) your failure to provide required disclosures to your customers.
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, with notice where reasonably practicable. Grounds for immediate termination include violation of these Terms, fraudulent activity, or actions that harm other users or third parties. Upon termination, your right to use the Service ceases immediately. Sections 5, 7, 9, 10, 11, and 13 survive termination.
These Terms are governed by the laws of the State of Idaho, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved through binding arbitration administered under the American Arbitration Association Commercial Arbitration Rules, with proceedings conducted in Ada County, Idaho. You waive the right to participate in any class action lawsuit or class-wide arbitration related to the Service.
We may update these Terms from time to time. We will notify you of material changes via email or through the Service at least 14 days before they take effect. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

Best AI Solutions, LLC ("Best AI Solutions," "we," "us," or "our") is committed to protecting the privacy of the businesses and individuals who use our platform. This Privacy Policy explains what information we collect, how we use it, who we share it with, and the choices you have.
This policy applies to: (a) our website at bestaisolutions.com; (b) the Best AI Solutions AI Agent platform and Control Center; (c) all AI agents and associated services. By using any of these, you agree to this policy.
Information you provide directly: Business name, address, phone number, email, industry, tax ID/EIN, billing information, and the content of your communications with Ava and our support team.
Information collected through AI agents: Phone call recordings and transcripts; text message content; website chat conversations; lead and customer contact information processed on your behalf; social media content published to or monitored on your accounts; and business performance data (reviews, rankings, ad metrics).
Information collected automatically: When you visit our website, we collect IP address, browser type, pages visited, time spent, referral URL, and device information via cookies and analytics tools (Google Analytics, Meta Pixel). See Section 8 for cookie details.
Information from third parties: Publicly available business information from Google, Meta, Yelp, Nextdoor, and other platforms that we use to power the AI Agent Blueprint and agent setup. Integration data from services you connect (Jobber, Housecall Pro, Stripe, Square, etc.).
We use the information we collect to: (a) provide, operate, and improve the Service; (b) train and configure AI agents to perform tasks on your behalf; (c) send you service notifications, weekly reports, and Ava communications; (d) process payments and manage your subscription; (e) respond to support inquiries; (f) detect and prevent fraud, abuse, and security incidents; (g) comply with legal obligations; (h) send you marketing communications where permitted (you may opt out at any time). We do not use your data or your customers' data to train general-purpose AI models for use outside of your account.
We share data with trusted service providers who process it on our behalf under data processing agreements. Key providers include:
We do not sell your personal information to third parties. We do not share your data for third-party advertising purposes without your consent.
All phone calls, text messages, and chat conversations processed through the Service are recorded and stored in an immutable audit trail with cryptographic verification. This applies to both inbound calls to your AI Receptionist and outbound communications sent by agents on your behalf. These records may contain personal information about your customers. You are responsible for providing legally required disclosures to your customers prior to any recorded interaction. Recordings are retained for the duration of your subscription plus 12 months after cancellation, then permanently deleted.
We implement industry-standard security measures including: AES-256 encryption at rest for all stored data; TLS 1.2+ encryption in transit; Google Secret Manager for API keys and credentials; role-based access controls with multi-factor authentication for administrative access; cryptographic hashing of audit records (tamper detection); and regular security reviews. No system is 100% secure. If you believe your account has been compromised, contact us immediately.
We retain your account data for the duration of your active subscription. Following cancellation, data is retained in read-only form for 12 months to allow data export, then permanently and irreversibly deleted. You may request earlier deletion (see Section 9). Some data may be retained longer where required by law (e.g., financial records).
When AI agents interact with your customers (answering calls, sending review requests, nurture messages, etc.), we process personal data about those individuals as a data processor on your behalf. You are the data controller for your customers' data. You are responsible for having a lawful basis for processing and for providing appropriate privacy notices to your customers. We process their data only to provide the Service to you and do not use it for any independent purpose.
Our website uses cookies and similar technologies for: (a) essential site functionality; (b) analytics (Google Analytics — anonymized); (c) advertising measurement (Meta Pixel — for conversion tracking on ads you may see). You can control cookies through your browser settings. Disabling cookies may affect site functionality. We honor browser-level Do Not Track signals where technically feasible.
Depending on your location, you may have the right to: access the personal data we hold about you; correct inaccurate data; request deletion of your data; receive a copy of your data in a portable format; object to or restrict certain processing; and withdraw consent where processing is based on consent. The Service is operated from and intended primarily for users in the United States. If you access the Service from outside the US, you understand that your data will be transferred to and processed in the United States. For users in the European Economic Area, United Kingdom, or Switzerland, we process personal data on the following legal bases: contract performance, legitimate interests, compliance with legal obligations, and consent (where required). You have additional rights under GDPR including lodging a complaint with your local supervisory authority. Data deletion requests can be submitted via our Data Deletion page or by emailing [email protected].
The Service is not directed to individuals under 18 years of age. We do not knowingly collect personal information from minors. If you believe we have inadvertently collected information from a minor, contact us immediately.
We may update this Privacy Policy from time to time. We will notify you of material changes via email or through the Service. The updated date at the top of this page reflects the most recent revision. Your continued use of the Service after changes take effect constitutes acceptance of the updated policy.

Deletion is permanent and cannot be undone. If you are a current subscriber, please cancel your subscription before submitting a deletion request.
